Open tickets count in a link

At project overview page, I have a message "You've got 5 open tickets for Intype Application". But when I click the link "5 open tickets" I got list of totally 8 tickets:
1. Incomplete (our custom "open" state)
2. New
3. Pending (our other custom "open" state)
4-8. Open
What I would expect is that the message shows "8 open tickets" that would lead to such list.
